IN OHIO – by Kayla Feritg

Married couples across Ohio are now able to create postnuptial agreements, which are contracts created by spouses after entering into a marriage. Up until 2023, Ohio and Iowa were the only states that had outlawed these agreements; the other 48 states had allowed some form of a postnuptial agreement between couples. Now, through Ohio Senate Bill 210, married couples can draw-up postnuptial agreements. Additionally, the new law allows married couples to modify or terminate a previously agreed upon prenuptial agreement.

Under Ohio's new law, a postnuptial agreement must be in writing and signed by both parties, entered into freely, and without fraud or duress. There must also be full disclosure and understanding of the nature, value, and extent of the property of both spouses. In addition, the agreement’s terms cannot promote or encourage divorce.

Postnuptial agreements could be a helpful estate planning tool, no matter what happens in marriage. The Law Library will be hosting a live, online CLE on this topic later this year. Look for a date and registration information soon.

Artificial intelligence (AI) is increasingly being used in the legal sector to help improve efficiency and accuracy. AI can help law firms in a variety of ways, from automating document review to helping with case management. AI can help attorneys quickly review large amounts of data to identify relevant documents and information, and it can recognize patterns that might otherwise be overlooked. AI may also be used to support legal research by quickly analyzing large amounts of data to identify relevant case law and other legal information. Additionally, AI can be used for predictive analytics to identify potential legal risks and opportunities. Finally, AI can be used to assist attorneys in making decisions, by providing recommendations based on data and analytics. AI can provide a great opportunity for law firms to become more efficient and accurate in their work and can potentially help attorneys make more informed decisions.
